Tekashi69 escaped jail time Friday after a lenient judge decided not to sentence him to three years in prison for violating his probation.

The “Gummo” rapper was instead sentenced to four years probation for using a child in a sexual performance.

Justice Felicia Mennin ordered 6ix9ine to complete 1,000 hours of community service and granted him youthful offender status, which will seal his criminal record.

The no-jail plea deal Tekashi took in 2015 was in jeopardy because of his repeated violations.

6ix9ine took the plea deal after being accused of engaging in sex acts with an underage girl.

At the time of the Saturday, Feb. 21, 2015 incident, Tekashi69 was 18 years old. The girl was 13 years of age. Tekashi appeared in video touching and fondling the child’s body parts, and standing behind her while “making a thrusting motion with his pelvis and smacking her on the buttocks,” according to a complaint filed with the criminal court of New York.

Tekashi and another adult, Taquan Anderson – nickname Tay Milly – appeared in at least three videos engaging in sexual acts with the then-13-year-old girl.

In the first video, the child – who is nude – engages in oral sexual intercourse with the separately charged defendant Anderson, while Tekashi stands behind the child making a thrusting motion with his pelvis and smacking her on her buttocks.

In the second video, the child is sitting on the Tekashi’s lap, and he has his arms around her. She is wearing a light colored bra, and dark colored underwear and Anderson pours a cup of liquid on the child’s breasts, and grabs the child’s breasts with his hands.”

In the third video, the child is completely nude and sitting across the laps of Anderson and Tekashi. Anderson touches the child across her legs and private region with his hand.

The videos were recorded the night of Saturday, Feb. 21, 2015

Tekashi admitted to being present the night the videos were recorded during an interview with New York City detective Maureen Sheehan.

“I went to a recording studio in Manhattan on Saturday, Feb. 21, and I met this guy Tay Milly at the studio. E was rolling with a bunch of guys and had a lot of money. They asked me if I wanted to come hang out with them uptown, and I thought why not, I just worked so hard in the studio, why not?”
Tekashi says he was taken to an upstairs unit in Uptown Harlem where he later met the 13-year-old victim.

“We were there for a little while when Tay Milly calls a girl on the phone and tells her to come over. She came over and we were all partying hard. I wasn’t doing drugs, I don’t drugs. I don’t know whether they were drinking.”

Tekashi admitted he was present when shown photographs of himself with the girl.

“That’s Tay and me at the studio. It was taken on the same day we went to the party. That’s me and the girl in the Instagram photo that says P 411 in the corner. That’s the girl Tay Milly called on the phone. I didn’t have sex with her. She was doing what she was doing.

“…I was doing it for my image. When she came in she asked me how old I was and I told her I was 18 and I assumed she was older. The way she was asking made me think she was older. Like 19. The still from the video from repost whizapp – that’s me and Tay Milly and the same girl. The repost whiz app is an app that you can repost things from other people’s Instagrams onto your own. I reposted the video from Tay’s Instagram to my own.”
