A 15-year-old girl from Gallup, NM was subjected to public humiliation by Wingate Elementary school officials upon learning of her pregnancy, according to KIB-TV. Shantelle Hicks was first kicked out of the school and later returned to have her pregnancy broadcasted in front of the entire student body by school officials in an assembly.
The public humiliated prompted the young mother to file a lawsuit against the school with the American Civil Liberties Union representing her. She feels her constitutional rights were violated.
The complaint states Hicks was asked to leave the school after her pregnancy was revealed. She was readmitted after ACLU of New Mexico notified official that it’s illegal to deny a student access to education for being pregnant.
Two weeks after Hicks returned to school, the director of the middle school and another staff member had Hicks stand before the entire middle school at an assembly and announced that she was pregnant. Until that point, no one other than Hicks’ sister knew that she was pregnant, according to the suit.
It was so embarrassing to have all the other kids staring at me as I walked into the gymnasium,” said Hicks, according to KOB. “I didn’t want the whole school to know I was pregnant because it’s not their business, and it wasn’t right for my teachers to single me out.”
The suit, filed on March 6, seeks damages and declaratory relief for violations of Hicks’ constitutional right to equal protection under the law and of Title IX prohibitions against sex and pregnancy discrimination in education.
