George Zimmerman’s Attorney: Facts Don’t Support a ‘Stand Your Ground Defense’

George Zimmerman’s attorneys are opting to change their original defense of Stand Your Ground to traditional self-defense, according to The Associate Press.

Attorney Mark O’Mara said the facts of the case don’t support a “stand your ground’ defense.”

“My concern with even calling it a `stand your ground’ hearing is we need to be more realistic,” O’Mara said, according to AP. “I’ve said from Day 1 we need to wait until all the evidence comes out.”

People, he said, look at the ‘stand your ground’ and immediately think somebody’s standing there with dead force and having the opportunity to back up but not having the need to under the statute.

“I think the evidence in this case suggests that my client was reacting to having his nose broken and reacted to that by screaming out for help,” he said. “He wasn’t in position where I think there was any suggestion where he could retreat, which he is allowed to do under the statute.”

Despite their change of defense, O’Mara still plans to have his client’s case dismissed during a ‘Stand Your Ground’ hearing.

A damaging piece of evidence was released last week revealing Zimmerman may have cocked his gun moments before his confrontation with 17-year-old Trayvon Martin.

This evidence, if found true, would inevitably prohibit Zimmerman’s defense from using ‘stand your ground’ as a defense. The evidence would also give grounds for the prosecution to charge Zimmerman with premeditated murder, a first-degree murder charge.

George Zimmerman is charged with second-degree murder in the shooting death of Trayvon Martin. He is currently free on a $1 million bail.
